Provision Of Information To Cooperative Agreement Holders

The information collection requirements of the DFARS 252.205-7000 clause, to provide information to holders of cooperation agreements, were approved by the Administrative and Budgetary Office at the control number 0704-0286 for use until 30 September 2007. SUPPLEMENTAL INFORMATION: Section 816 of Public Law 108-375 has increased from USD 500,000 to USD 1,000,000, and the threshold at which defence firms must provide co-operating contract holders with information on the sub-mandate of contract staff has been increased on demand. This intermediate rule amends the recipe for DFARS 252.205-7000 which contains this requirement in DFARS 205,470 to reflect the new dollar threshold by removing 500,000 USD and replacing it with 1,000,000 USD. SYNOPSIS: This intermediate rule allows DFARS 205.470, the contractual implementation clause of Section 816 of the National Defense Authorization Act for Fiscal Year 2005 (Public Law 108-375), which increases the threshold, from which a DOD DFARS contract must be increased from $500,000 to $1,000,000 to $252,205-7000 to provide information to co-op contract holders. DFARS 252.205-7000 requires contractors to provide contract holders with cooperation contracts, upon request, with a list of the subcontractor`s staff. DoD adopted an interim rule to amend the Federal Defence Of Acquisition Regulations (DFARS) to implement Section 816 of the National Defense Authorization Act for fiscal 2005. Section 816 increases the threshold at which a dod contract must include the obligation for the contractor to submit to the holders of cooperation contracts, upon their request, a list of the contracting contractor responsible for the subcontracting. Under the authority of the Minister of Defence, it was found that there were urgent and compelling reasons to publish an interim rule before the public was able to comment. This interim rule implements Section 816 of the National Defense Authorization Act for fiscal year 2005 (Public Law 108-375).

Section 816 amends 10 U.S.C 2416 (d) of the threshold at which a dod contract must include the obligation for the contractor to submit to the holders of cooperation contracts, upon their request, a list of the personnel of the contractor responsible for subcontracting. Section 816 came into force with the Dement board on October 28, 2004. The opinions received in response to this transitional rule are taken into account when the final rule is formed.
